MCA Member and Guest Waiver

In consideration of being permitted to participate in Activities sponsored, promoted, organized, supervised, controlled, engaged, held, run and/or conducted (“MCA Activity or Activities”) by the Jewish Federation of Greater Naples, Inc. ( “Federation”), and the Men’s Cultural Alliance (“MCA”) an organization under the umbrella of the Federation, jointly referred to as the (“Released Parties”), I agree to the following:

I acknowledge and understand that the MCA Activities I participate in may have inherent risks associated with them, which I have fully investigated and accepted. These risks include but are not limited to property damage and loss, death and injury by accident, disease or terrorist act.

I further assert that I am fully qualified to participate in the MCA Activities I have elected to join and participate in, and that I have obtained appropriate training to do so. I further acknowledge that I have no physical or mental condition that would impair or impede my ability to join and participate in those MCA Activities. I further acknowledge, and agree that I will use my own independent judgment whether I should participate in any MCA Activity in whole or in part, and that if at any time I determine, using my own independent judgment, that a MCA Activity is beyond our physical or mental condition or ability, or that I do not have sufficient instruction and/or training to participate in that MCA Activity I will immediately cease my participation in that MCA Activity. I acknowledge, understand, and agree that I have not relied upon any information from the Released Parties nor has the Release Parties provided any information to me to assist in any way in making any of these assessments and/or determinations for me.

I acknowledge, understand and agree that I am not relying upon any information provided by the Released Parties, nor am I relying upon the failure of Released Parties to provide information to me in making independent assessments and/or determinations with respect to the risk of contracting COVID-19 while participating in MCA Activities,

In consideration of the forgoing I, hereby waive, release, discharge and hold harmless (“Waiver and Release”) the Released Parties, their directors, officers, members, employees, volunteers, successors, event leaders and assigns from any and all claims, demands, obligations, liabilities, indebtedness, deposits, breaches of contract, breaches of duty or any relationship, acts, omissions, negligence, misfeasance, malfeasance, cause or causes of action, including but not limited to claims arising out of exposure to COVID-19, debts, sums of money, accounts, compensations, contracts, controversies, promises, legal or financial responsibility, damages, costs, losses and expenses, of every type, kind, nature, description or character, whether legal or equitable for personal injury, disability, illness, damage, or death (“Injuries”). I understand and agree this Waiver and Release is applicable whether my Injuries, or that of my guest occur before, during, or after my participation in an MCA Activity. I understand and agree that this Waiver and Release is applicable irrespective of facts or information which in any way I claim led to my Injuries, whether those facts are known or unknown, now, at the time I participated in the MCA Activity, or in the future.

The provisions of this release shall inure to the benefit of, and shall bind, me, my heirs, executors, administrators, successors, and assigns. I understand that there are no time limitations on this release. This waiver and release remain in effect unless specifically canceled in writing and delivered to the President of MCA.

This release contains the entire agreement between me and the Jewish Federation of Greater Naples, the MCA and supersedes all prior or contemporaneous agreements. This release shall be interpreted and enforced in accordance with the laws in the State of Florida without regard to its conflict of law rules and shall be construed as broadly and inclusively as permitted by such laws. If any provision of this release is held invalid by any court of competent jurisdiction, in such event, the balance of this release shall continue in full force and effect and be enforced as if the invalid portion were not contained in this release.

I have carefully read this release and understand its contents and acknowledge that this is a release of liability and such is a binding and fully enforceable contract between me, on one hand, the MCA, and the Jewish Federation of Greater Naples. I have consulted, or have had the opportunity to consult, my own counsel as to the meaning and legal effect of the release, voluntarily signed this release or accepted on the MCA Website
