Who Have Litigated and Settled Opioid Cases

Every MCA member has been touched by the National Opioid Epidemic.  Many of you know someone – perhaps in your own family, or a friend’s family – who has suffered or dealt directly with opioid addiction.  And as overdose deaths skyrocket, more and more of your tax dollars are being used to address the resulting social ills.

In 2017, cities and counties across the country started to file lawsuits against opioid-related companies, claiming their actions caused the Epidemic and created a “public nuisance.” The defendants are some of the largest companies in the world and include: (1) opioid manufacturers, like Purdue Pharma and Johnson & Johnson; (2) opioid distributors, like Cardinal Health; and (3) opioid dispensers, like Walmart and Walgreens.  

Every opioid lawsuit in federal court (over 3,000 cases) was transferred into a single “Multi-District Litigation (MDL),” overseen by Judge Dan Aaron Polster in Cleveland, Ohio.  Judge Polster appointed MCA Member David R. Cohen as Special Master to oversee the MDL.  David also oversees the national settlements – so far totaling over $30 Billion – that some of the parties have reached.

David will present the history of the litigation and describe his role as Special Master.  In addition, David will be joined by a who’s who of attorneys who have actually litigated and settled the Opioid cases: Sheila Birnbaum, Counsel for Purdue and the Sackler Family; Enu Mainigi, Trial Counsel for Cardinal Health; Peter Weinberger, Plaintiffs’ MDL Liaison and Trial Counsel; and Mark Lanier, Plaintiffs’ Lead Trial Counsel.  Each of these attorneys has a stellar national reputation and has spoken at legal seminars across the country.  Interestingly, David, Sheila, Enu, and Peter are all part-time Naples residents.
